By downloading, installing, or using the Ai Dance application ("Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Service.

These Terms constitute a legally binding agreement between you and Ai Dance ("we," "our," or "us").

Ai Dance is an AI-powered dance video generation platform that allows users to:

• Create AI-generated dance videos from your own footage
• Apply music synchronization and visual effects
• Download and share your created dance videos

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

You must be at least 13 years old (or 16 in the EEA) to use our Service. By using Ai Dance, you represent that you meet these age requirements.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4.1 Account Creation

• Your account is automatically created using your device identifier
• You are responsible for maintaining the security of your device
• You agree not to share access to your account with others

4.2 Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use
• We reserve the right to suspend accounts that violate these Terms

5.1 Subscription Plans

• Subscription plans provide access to premium features and credits
• Credits are used for AI dance video generation

5.2 Billing

• All purchases are processed through Apple's App Store
• Prices are displayed in your local currency
• Prices may vary by region and are subject to change

5.3 Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

5.4 Refunds

• Refund requests are handled by Apple according to their refund policy
• We do not directly process refunds for App Store purchases
• Contact Apple Support for refund inquiries

5.5 Credits

• Credits are non-transferable and have no cash value
• Unused credits from subscriptions do not roll over to the next period
• Credits purchased as one-time purchases do not expire while your account is active

6.1 Your Content

You retain ownership of content you create, including:

• Videos you upload
• Dance content you generate
• Videos produced by the AI from your inputs

6.2 License Grant

By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to:

• Process your videos and inputs to generate dance content
• Store and display your content within the Service
• Use anonymized data to improve our AI systems

6.3 Prohibited Content

You agree NOT to upload or create content that:

• Is illegal, harmful, or offensive
• Infringes on intellectual property rights of others
• Contains real persons without their consent (except yourself)
• Depicts minors in inappropriate situations
• Contains hate speech, violence, or explicit sexual content
• Attempts to deceive or defraud others

6.4 Prohibited Activities

You agree NOT to:

• Reverse engineer or attempt to extract our AI models
• Use automated systems or bots to access the Service
• Circumvent any security measures or usage limits
• Resell or redistribute our Service without authorization
• Use the Service for any illegal purpose

7.1 Nature of AI Content

• Dance videos are generated by artificial intelligence based on your inputs
• AI outputs may not always be perfect or as expected
• We do not guarantee specific results or quality levels

7.2 Content Moderation

• We may review content for policy violations
• We reserve the right to remove content that violates our policies
• Repeated violations may result in account suspension

7.3 No Endorsement

AI-generated content does not represent our views or endorsements. Users are responsible for how they use and share generated content.

8.1 Our Property

The Service, including its design, features, and technology, is owned by Ai Dance and protected by intellectual property laws. You may not:

• Copy or modify our software or technology
• Use our trademarks without permission
• Create derivative works from our Service

8.2 Your Rights

• You own the dance videos you create using our Service
• You may use, share, and commercialize your created content
• We do not claim ownership of your original videos or inputs

9.1 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of results

9.2 No Guarantees

We do not guarantee:

• Uninterrupted or error-free service
• That defects will be corrected
• That the Service is free of viruses or harmful components
• The accuracy, completeness, or usefulness of any content

TO THE FULLEST EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

You agree to indemnify and hold harmless Ai Dance and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Content you create or upload

12.1 By You

You may stop using the Service at any time. To delete your account, contact us at support@songdio.ai.

12.2 By Us

We may suspend or terminate your access:

• For violation of these Terms
• For fraudulent or illegal activity
• For extended periods of inactivity
• At our sole discretion with or without notice

12.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and content
• Provisions that should survive termination will remain in effect

13.1 Governing Law

These Terms are governed by the laws of the jurisdiction where Ai Dance is incorporated, without regard to conflict of law principles.

13.2 Arbitration

Any disputes shall be resolved through binding arbitration rather than court, except for claims that may be brought in small claims court.

13.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Updating the "Last Updated" date
• Sending a notification for significant changes

Continued use after changes constitutes acceptance of the new Terms.

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ai Dance.

15.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right does not waive our right to enforce it later.

15.4 Assignment

You may not assign these Terms. We may assign our rights to any affiliate or successor.
